Obesity Suit Against McDonald’s Dismissed. U.S. District Judge Robert Sweet threw out the suit in its entirety: “This opinion is guided by the principle that legal consequences should not attach to the consumption of hamburgers and other fast food fare unless consumers are unaware of the dangers of eating such food.” Chalk one up for accountability.

I think this McNugget Arrest is potentially a bigger story than the suit: if indeed this guy was calm while using a single four-letter description of a burnt nugget, and he was arrested for his free expression, isn't that an infringement of his civil rights? Instead of speaking against the gov't, which will never get you arrested (well, not until Ashcroft gets to changing that), but this guy spoke out against the lowest branch of corporate America and was promptly escorted to jail. If you can't curse a burnt McNugget from a McDonalds within a WalMart, then what's next?

Of course, if he was livid, then it is indeed a breach of peace, but either way this should really be dismissed...

haha. If this continues, it wont be long before McDonalds has its own reality show. Instead of 50 potential brides for one millionaire, theyll be 50 potential McDonalds lawsuits and a hotshot lawer. Cases ranging from fat grams to four letter words. I thought this type of thing could only happen in Utah. Amazing. and sad.

I think that there could be a case put forth for user expectation here. Users don't expect to shop in an environment where an individual with a burnt McMostlyMeat and a penchant for vulgarity and a lack of inner monologue disrupts their experience.

Well, maybe they do at a McD in Walmart. But in general I would say most don't prefer that sort of atmosphere. So do we let the "free market" allow them to shop elsewhere?

And if I am mistaken and people like that kind of atmosphere, then we need to add something to the Web sites we work on. Just think of all the cool error messages we could write!
