Yeah, sure, anyone can find silly lawsuits. Doesn't mean they'll win. And even when they do win, they usually get overturned or reduced.
There's no question people are too quick to sue - although in general lawyers can't sue; they have to find the clients who are willing to sue - but it's also true that lawyers overreact in all directions. I have to deal with legal all the time at work, and the things they react to and want changed are downright comical at times.
And my original question still stands: Why the hell do you need terms and conditions for package tracking? FedEx doesn't do it, at least in terms of making you click. UPS didn't either.
Lawyers are basically like guns. They can be used for good or bad, and even though they're everywhere else in the world -- they seem to be extra dangerous here in America for some reason.
I would say TOUs are appropriate in this situation. Shipping and receiving is very sensitive. I could easily see major problems originating from incorrect tracking information and very disgruntled parties.

If I see that meki spam one more time....somebody really nees to shut that idiot down. I can understand the need to the T&C on tracking - its not foolproof. I've had packages arrive even though the website showed it being thousands of miles away.
The really sad thing is the fact that the lady won. I can't believe I live in the same town as this whiner.
